These Terms of Service ("Terms") govern your access to and use of the Tekswing website, platforms, products, and services (collectively, the "Service") operated by Tekswing ("us," "we," or "our"). By using the Service, you agree to these Terms.
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part, you may not use the Service.
2. Accounts
If you create an account, you are responsible for maintaining the security of your credentials and for all activity under your account. You must provide accurate and complete information. Notify us immediately of any unauthorized use.
3. Services & Projects
We provide custom software development, SaaS products, and related technology services. Specific project terms, deliverables, timelines, and pricing are agreed upon separately via proposals or statements of work.
4. Intellectual Property
The Service, including its content, features, branding, and code, is the exclusive property of Tekswing and its licensors, protected by copyright, trademark, and other laws. Client deliverables are governed by the applicable project agreement.
5. Prohibited Activities
- Reverse engineering, decompiling, or disassembling any part of the Service
- Using the Service for unlawful purposes or to harm others
- Attempting to interfere with security features or gain unauthorized access
- Scraping, data mining, or automated collection without written permission
- Impersonating others or providing false information
- Uploading malicious code, viruses, or harmful materials
6. Payment & Billing
For paid services and subscriptions, billing terms are specified in the applicable agreement or checkout process. Payments are processed securely through third-party payment providers. You agree to pay all applicable fees on time.
7. Termination
We may suspend or terminate your access at any time for violation of these Terms. You may stop using the Service at any time. Provisions that should survive termination (including IP, liability, and indemnity) will remain in effect.
8. Limitation of Liability
To the maximum extent permitted by law, Tekswing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
9. Disclaimer
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
10. Governing Law
These Terms are governed by the laws of Pakistan. Any disputes shall be resolved in the courts of Pakistan.
11. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated with reasonable notice. Continued use after changes constitutes acceptance.
